Carol Blake v. University Hospital Board of Management [2018] JMSC. Civ. 95

The Supreme Court handed down the attached judgment in favour of the University Hospital Board of Management. The claim was based on alleged Medical Negligence following an open fracture to the patient’s ankle which became infected with a rare flesh-eating bacteria which left the affected limb grossly deformed. The patient alleged this was due to delay in treatment, especially surgery, which could have prevented infection of the wound.

The court accepted expert evidence called by the hospital which showed that the management of the patient throughout conformed to good medical practice and the infection was not caused by any want of care, but by a known complication of open fractures.
